TERMS & CONDITIONS

AVAILABLE ON A FIRST-COME, FIRST-SERVED BASIS. QUANTITIES ARE LIMITED. OFFER WILL BE GOVERNED BY U.S. LAW. DO NOT PARTICIPATE IF YOU ARE NOT ELIGIBLE AND LOCATED IN THE UNITED STATES.

Sponsor: Mars Wrigley Confectionery US, LLC, 110 Edison Place, Newark, NJ 07102 (“Sponsor”).

Offer Period: The EXTRA^® Gum Ritual Packs Promotion (the "Offer") will take place on December 2, 2025 beginning at 12:00:00 AM Eastern Time (“ET”) and ending on December 16, 2025 at 11:59:59 PM (ET) OR when all available Rewards (as defined below) have been claimed (the “Offer Period”), whichever occurs first. The Offer Period will consist of three (3) Entry Periods (each, an “Entry Period”), where for each Entry Period, a designated social media influencer will post collaborative content on Instagram along with the EXTRA Gum^® brand’s Instagram account (@extragum). Participants must be one of the first one hundred (100) Instagram users to comment to the designated social media influencer’s and EXTRA Gum^® brand’s collab post including the Hashtag and providing an answer to the prompt and must follow the EXTRA Gum^® brand on Instagram, as directed, once the Entry Period has begun, in order to receive a Reward (as further described below).

Entry Periods, social media influencers and number of available Rewards are as follows:

During the Offer Period and each Entry Period, a limited quantity of Rewards will be made available for free on a first-come, first-served basis, as noted above.

Eligibility: Offer is available only to legal residents of the fifty (50) United States and the District of Columbia, who are 18 years of age or older and who meet all the requirements in these Terms & Conditions (each a "Participant"). Employees of Mars Wrigley Confectionery US, LLC (“Sponsor”), its parent company, affiliates, subsidiaries, advertising agencies, and any other company or individual involved with the design, production execution or distribution of the Offer (collectively, the "Promotion Entities"), as well as the immediate family (spouse, parents and step-parents, siblings and step-siblings, and children and step-children and their respective spouses, regardless of where they reside) and household members of each such employee, whether or not related, are not eligible to participate. The Offer is subject to all applicable federal, state, and local laws and regulations. Participation constitutes each Participant's full and unconditional agreement to these Terms and Conditions (“Terms”) and Sponsor's decisions, which are final and binding in all matters related to the Offer. The Offer is void where restricted or prohibited by law.
 

How To Participate: During one or more of the Entry Periods, participants must go online to Instagram (http://www.instagram.com) and log into their Instagram account. You must be a registered Instagram member to participate. Instagram account registration and participation in the Offer are free. To create a free Instagram account, go to the Instagram website and follow the instruction to create a new account. 

Once logged into Instagram, a participant must be one of the first one hundred (100) Instagram users to complete a comment using #EXTRARituals (the “Hashtag”) on one (1) of the three (3) influencer collab posts with the EXTRA^® Gum brand (“Brand”) for the respective Entry Period including an answer to the prompt; and must follow the EXTRA Gum^® brand’s Instagram account (@extragum). If you (the participant) are one (1) of the first one hundred (100) participants to respond during an Entry Period, you will receive a Direct Message (“DM”) on Instagram from the Brand in order to complete the process to receive a Reward (as further described below). Once a participant responds to the Brand’s DM, they will then receive a link to a reward claim form. In some instances, the reward claim link may be provided via a link in bio instead of sent via DM. Once the reward claim form has been completed, the qualifying participant will receive a “Thank You” message. In order to be eligible to receive a Reward, you must complete the reward claim form using the link provided.

Proof of submission on Instagram is not considered proof of delivery to or receipt by Sponsor of such submission. No group or organization requests will be honored. Submissions made by any other individual or any entity, and/or originating at any website or other social media platform, including but not limited to commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified. The use of any device to automate the submission process is prohibited. By participating with a wireless device, participant must agree to accept all applicable charges associated therewith. Message and data rates may apply. Participation via a wireless device is designed to work with most of the U.S. major wireless carriers, but Sponsor makes no guarantee that any wireless service provider will participate, and the wireless device that is used must be capable of completing the submission at the Website. Direct any questions, comments, or complaints regarding the Offer to Sponsor, not Instagram.

Offer Rewards are distributed solely on a first come, first served basis.

Limit one (1) Reward per person/email address per Entry Period. Any attempt by a Participant to exceed this limit by using multiple or different social media accounts, phone numbers, email addresses, identities, registrations, or any other methods may result in disqualification, and any existing Reward claim may be voided. All Reward claims are subject to verification and compliance with these Terms. If multiple claims are received from the same social media account, address or email address, then only the first claim will be valid.

Rewards: Three hundred (300) Rewards will be available in the Offer (one hundred (100) Rewards each Entry Period). Rewards are available on a first-come, first-served basis. Each Reward includes: one (1) of three (3) EXTRA^® Gum Ritual Packs (Pop Art Ritual Pack (Reward available from @mia_yilin), Gumigami Ritual Pack (Reward available from @ellharve); Chewoodle Ritual Pack (Reward available from @fatimahs_guide) – to be awarded is at sole discretion of Sponsor, dependent on which of the three (3) different social media posts the recipient commented on); one (1) pack (15-ct.) of EXTRA^® Gum; and a small activity kit (each, a “Reward”) / Approximate Retail Value $45.67 (Pop Art Ritual Pack), $36.38 (Gumigami Ritual Pack), $39.28 (Chewoodle Ritual Pack). Please allow 4-6 weeks for delivery.

Reward will be fulfilled to the recipient approximately 4-6 weeks after the end of the Offer Period. Participants are responsible for all federal, state, and local taxes, as well as all costs and expenses associated with reward acceptance and use not specified herein as being provided. Rewards are non-refundable and non-transferable, except at sole discretion of Sponsor. Participants acknowledge that once a Reward has been sent, Sponsor is not responsible for any undelivered and/or lost Rewards, and no replacement will be supplied.

General Conditions: Promotion Entities reserve the right, in their sole discretion, to cancel, modify, extend, or suspend the Offer at any time for any reason. In the event of any such disruption, the Sponsor will post a notice at https://www.extragum.com/back-to-school. Participation constitutes the Participant's understanding of and full and unconditional agreement to these Terms. If there is a dispute over the identity of a Participant, the authorized account holder of the social media account and/or email account will be deemed the Participant, at the sole discretion of the Sponsor. The "Authorized Account Holder" is defined as the natural person in whose name the social media account and/or email account was opened if such person is otherwise eligible in accordance with these Terms. If a dispute regarding the identity of a Participant cannot be resolved to the satisfaction of the Promotion Entities, the affected claim will be deemed ineligible.

Limitations and Releases: Any attempted form of participation into the Offer, other than the participation method stated, is prohibited. Promotion Entities, their respective affiliates, partners and promotion and advertising agencies are not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless phone connections, website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an participant’s ability to participate in the Offer, including any injury or damage to participant’s or any other person’s phone, computer or other matter relating to or resulting from participating in this Offer or downloading any materials in the Offer. If for any reason the online participation portion of the Offer is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Offer, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the submission process, and to cancel, terminate, modify or suspend the Offer; and award the Rewards from among all eligible non-suspect submissions received up to the action taken by the Sponsor provided a sufficient number of eligible submissions have been received.  Caution: Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Offer is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent of the law. 

Publicity Grant: Each Participant agrees to allow use of their name, user name, any comment made to Sponsor’s Instagram account in response to an Offer post, likeness, city and state of residence, and/or biographical information for promotional purposes (including posting on Sponsor’s website), in any and all media, now or hereafter known, worldwide in perpetuity, without additional compensation or notification to, or permission from, entrant, except where prohibited. 

Indemnity: Participants shall indemnify, defend and hold harmless the Promotion Entities and each of their respective parents, affiliates, divisions, subsidiaries, successors, assigns, and licensees, and each of their respective employees, shareholders, officers, directors, contractors, advertising and promotion agencies, agents and representatives (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Offer or receipt or use or misuse of any coupon provided.

Privacy: Information provided by Participants will only be used as provided in these Terms and will be treated in a manner consistent with the Sponsor’s Privacy Policy at mars.com/privacy.

Governing Law and Venue: Any dispute arising from these Terms and the Offer will be governed by and construed and enforced in accordance with the laws of New Jersey except to the extent preempted by U.S. federal law, without regard to conflict of law rules or principles (whether of New Jersey or any other jurisdiction) that would cause the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or cannot be heard in small claims court will be resolved in the state or federal courts of New Jersey and the United States. 
 

Limitation of Liability; Disclaimer of Warranties and Release; and Dispute Resolution: FOR CLARITY, PARTICIPATION IN THE OFFER IS SUBJECT TO, AND YOU AGREE TO, THE RELEASES, OBLIGATIONS, DISPUTE RESOLUTION PROCEDURE, AND OTHER TERMS SET FORTH IN THIS SECTION AND IN THE “DISPUTE RESOLUTION” SECTION (SECTION 10) OF THE MARS TERMS & CONDITIONS, AVAILABLE AT MARS.COM/LEGAL, WHICH ALSO APPLY TO DISPUTES, CLAIMS, OR ANY OTHER RELEVANT ASPECT ARISING FROM THE OFFER OR FROM THESE TERMS.

THIS OFFER IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM. INSTAGRAM IS COMPLETELY RELEASED OF ALL LIABILITY BY EACH PARTICIPANT IN THIS OFFER.
